Colors must be chosen and a Color Choice Agreement must be signed one (1) week prior to start date. An additional cost will be charged for color changes made after work begins.

NOTE : Certain accent colors are inherently less opaque and may require more than one coat to achieve a satisfactory and uniform appearance. Using these colors may result in additional costs. Customer will be notified and an Additional Work Order (AWO) shall be required above the price of the original contract.

All work is to be completed in a workman-like manner according to standard practices. Worker/s will remain on job until completion of project. Work site will be cleaned daily and upon project completion. All agreements are contingent upon the absence of strikes, accidents or delays beyond our control.

For your safety, no one is permitted in work areas other than employees of Color Your World. As with all home improvement projects, children and pets should be kept away from work areas and from Color Your World supplies and equipment.

Please have the area ready where we are going to paint before the co-workers arrive.

It is essential that work areas be available exclusively to Color Your World, free from other tradespeople, installers, cleaners, etc.

Make any necessary arrangements for pets.

Remove any valuable, fragile or previously broken items from the job site. Items we do not move include valuable or fragile art, or previously broken or fragile furnishings.

Any customer responsibilities not completed may result in additional labor and material costs and require an Additional Work Order (AWO).

The customer must be available to meet with the Color Your World Crew Leader on the last day of the job.

Because of unforeseen conditions, additional repairs/costs may become necessary. The customer will be notified if any such conditions exist at time of discovery and will be required to sign an Additional Work Order (AWO) for said repairs. Examples of unforeseen conditions are: dry rot, moisture damage, high/elevated substrate moisture content, excessive UV damage, dead wood fibers, etc. Should the customer decide to opt out of performing contractor recommended repairs, we are NOT responsible for the damages that will cause in the future.

Carpentry/Wood Repair to be done on a Time and Materials basis will be billed at an hourly rate of $80 per hour unless otherwise agreed upon and noted in the job description. Materials used will be billed at a rate of cost plus 30% per industry standards.

We propose to furnish material and labor – complete and in accordance with the proposal specifications, for the sum of all as stated in the proposal. If only partial tasks are completed from the full job description, additional pricing may be required.

The quoted price is valid for 30 days, unless otherwise noted.

Change orders or additional work orders become part of the contract once the order is prepared in writing and signed by the parties prior to the commencement of any work covered by the new change order or additional work order. The order shall describe the scope of the extra work or change, the cost to be added or subtracted from the contract, and the effect the order will have on the schedule of progress billing.

All change orders and/or additional work orders shall be subject to progress billing.

Residential Interior/Exterior Painting (2 Years)

Color Your World provides a limited two (2) year warranty for all residential Interior and Exterior Painting. If any paint failure, including chipping or peeling occurs on any Interior or Exterior painted or stained surface due to workmanship error for the period of two (2) years, we will provide all Labor and Materials to repaint the affected area. This limited warranty is contingent upon receipt of full payment, as billed, for the work that was completed.

This limited warranty excludes all painted or stained horizontal surfaces (i.e. decks, floors, steps, cap rails, horizontal window trim ledges, thresholds, etc.). This limited warranty excludes coating failure due to rot, dead wood fibers as a result of previous excessive UV exposure to bare wood areas, mold or water damage of any kind, high/elevated moisture content levels in substrate, excessive temperature changes, settlement, acts of nature, insect or pet damage, previous coating failure or abuse, previous repaired/patched sections exceeding ¼ inch deep, repeated abrasion, reoccurring or newly formed cracks in the painted surface and all surfaces painted with customer supplied material. This limited warranty excludes “nail pops” and/or “cracks” in caulked/patched areas as result of expansion and contraction in wood, plaster and drywall surfaces. This limited warranty also excludes rust/corrosion/oxidation formation on any and all interior and exterior metal surfaces including nail/screw heads, flashing, deck and railing hardware, metal lights and fixtures, metal garage doors, metal entry doors, etc. This limited warranty excludes windows with compromised seals resulting in condensation inside of pane. Interior and exterior faux/specialized finishes are not covered in this limited warranty. Slight fading of bright or deep colors over time is normal and is not considered paint failure.

Residential Carpentry/Construction Limited Warranty:

Color Your World warrants all labor performed and material installed at job site, in accordance with the contract, drawings, specifications, alterations and additions thereto, for a period of (1) one year from date of installation.

The warranty provided by this limited warranty is limited in coverage. The performance standards provided in this limited warranty are the only express warranties covering the home. To the extent allowed by law, Color Your World shall not be liable for any incidental or consequential damages relating to, or resulting from, any damage to, or defect in, the home, other improvements or the lot on which the home is located.

Under This Limited Warranty, Color Your World does not warrant and shall not be responsible for, and this Limited Warranty shall not extend to or include, or be applicable to, any of the following:

Any work performed or material supplied incident to construction, modification or repairs to the Home performed by Owner, or by anyone on behalf of Owner, other than Color Your World or its employees, agents, subcontractors or contractors providing work or materials at the direction of Color Your World.

Any damage to the Home, to the extent it is caused or made worse by the failure of Owner or by anyone other than Color Your World, its employees, agents, subcontractors or contractors providing work or materials at the direction of Color Your World, to comply with the warranty requirements of the manufacturers of any fixtures, appliances and equipment.

Alterations to the grade of the soils, except alterations done by Color Your World, its employees, agents, subcontractors or contractors providing work or materials at the direction of Color Your World.

Dampness or condensation due to the failure of Owner to maintain adequate ventilation, or the effects of such failure on the Home or any other Defect to the Home caused by moisture, rot, mildew or rust.

Normal wear and tear or normal deterioration.

Normal shrinkage resulting from drying or settlement of construction components within the tolerance of building standards.

Loss or damage caused by or resulting from or in connection with all named weather events, accidents, riot and civil commotion, fire, explosion, smoke, water escape, falling objects, aircraft, vehicles, lightning, windstorm, hail, flood, hurricane, drought, tropical storms, gale force winds, freezing or extreme temperatures, mudslide, earthquake, or other Acts of God, wind driven rain or other water, subsidence or sinkholes, changes in the underground water table, or below ground water that exerts pressure on, seeps, or leaks into the Home, sidewalk, driveway, foundation, swimming pool or other structure.

Loss or damage caused by or resulting from seepage of water, unless such loss or damage is a direct result of a Defect.

Loss or damage caused by or resulting from soil movement including without limitation heaving, subsidence, expansion or lateral movement of the soil for which compensation is provided by legislation or which is covered by insurance.

Damage caused by erosion or accretion following the Warranty Commencement Date.

Damage caused directly or indirectly by insects, birds, rodents, vermin or other wild or domestic animals.

Loss or damage which arises while the Home is being used for nonresidential purposes or for purposes for which the Home was not designed; loss or damage caused by or resulting from abnormal loads placed on floors by Owner or which otherwise exceed normal design load; loss or damage caused by or resulting from unusual or abnormal demand on the electrical system or which otherwise exceeds the normal design electrical capacity or other damage that results if the Home has not been maintained, or has been negligently damaged or abused.

Cost of or responsibility for moving pianos, pool tables, antiques, fine furniture or other items, which would generally require special handling; costs of shelter, transportation, food, moving, storage, or other expenses related to inconvenience or relocation during repairs.

Any condition which does not result in actual physical damage to the Home, including, but not limited to, un-inhabitability or health risk due to the presence or consequence of radon gas, formaldehyde or other pollutants or contaminants, or the presence or effect of hazardous or toxic materials.

All invoices produced shall be due and payable at the time of invoicing. Late fees apply 7 days from invoice date: 1.5% per month charge will be added to all open invoices that are more than 7 days past due. Annual percentage rate will be 18%.

Deposit:

Upon acceptance of a proposal, a deposit in an amount equal to 20%-30% depending of the quote, shall be required. The amount of the deposit will be discounted to the total amount of the quote.

GENERAL LIABILITY INSURANCE

Color Your World carries full workers’ compensation insurance for all employees.

NOTE ABOUT EXTRA WORK AND CHANGE ORDERS:

Extra work and change orders or additional work orders become part of the contract once the order is prepared in writing and signed by the parties prior to the commencement of any work covered by the new change order or additional work order. The order shall describe the scope of the extra work or change, the cost to be added or subtracted from the contract, and the effect the order will have on the schedule of progress payments, if any.

Performance of Extra Work or Change-Order Work Notice:

1) Color Your World is not required to perform additional work or changes without written approval in a “Change Order” or “Additional Work Order” before any of the new work is started.

2) Extra work or a change order/additional work order is not enforceable against a buyer unless the order also identifies all of the following in writing prior to the commencement of any work covered by the new order:

The scope of work encompassed by the order.

The amount to be added or subtracted from the contract

The effect the order will make in the progress payments (if any) or the completion date.

3) Color Your World’s failure to comply with the requirements of this paragraph does not preclude the recovery of compensation for work performed based upon legal or equitable remedies designed to prevent unjust enrichment.
